  • "Account": Your registered user profile

3. Separate Tradesperson Agreement

Important Notice for Tradespeople:

If you wish to be listed as a tradesperson in our directory, you must enter into a separate Tradesperson Listing Agreement which governs:

  • Verification and registration requirements
  • Insurance and professional standards
  • Listing fees and payment terms
  • Quote request processes
  • Work obligations and standards
  • Liability and indemnification

The Tradesperson Listing Agreement contains additional terms specific to operating a business through our Platform. These general Terms and Conditions apply to all users, but tradespeople are also bound by the additional provisions in their Listing Agreement.

4. Eligibility and Account Registration

4.1 Age Requirement

You must be at least 18 years old to use our Service. By using the Platform, you confirm that you meet this age requirement.

4.2 Browsing vs. Account Registration

Browsing Without Account:

  • You may browse the tradesperson directory without registering
  • You can view trade categories, locations, and general information
  • You cannot submit quote requests or save favorites

Account Registration (Homeowners):

  • Required to submit quote requests
  • Required to save favorite tradespeople
  • Allows you to track your enquiries and communications
  • You must provide accurate contact information

Tradesperson Registration:

  • Requires completion of separate Tradesperson Listing Agreement
  • Subject to verification and approval process
  • Governed by additional contractual terms
4.3 Account Responsibilities

You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

You may not:

  • Create an account using false or misleading information
  • Create multiple accounts for the same person
  • Share your account credentials with others
  • Use another person's account without permission
4.4 Account Termination

We may suspend or terminate your account if:

  • You breach these Terms
  • You provide false or misleading information
  • Your actions harm other users or our Platform
  • We are required to do so by law
  • Your account has been inactive for over 2 years

You may close your account:

  • Your right to use the Service ceases immediately upon termination

"We strive to resolve disputes amicably. If a resolution cannot be reached, we may refer the matter to arbitration as per our policies."

5.1 Directory and Connection Platform

We Provide:

  • A searchable directory of verified tradespeople
  • Tools to submit and manage quote requests
  • A platform facilitating communication between homeowners and tradespeople
  • Information about trades, projects, and home improvement topics
  • Reviews and ratings from other homeowners

We Do NOT Provide:

  • The actual trade services (these are provided by independent tradespeople)
  • Employment or agency services (tradespeople are independent businesses)
  • Guarantees about work quality, pricing, or completion
  • Insurance or warranties for work performed
  • Project management or supervision
  • Legal, financial, or professional advice
5.2 Platform as Facilitator Only

Critical Understanding:

Your Next Builder is a directory and introduction service only. We:

  • Connect homeowners with tradespeople
  • Facilitate initial communication
  • Display information provided by tradespeople

We are NOT:

  • Party to any agreement between homeowner and tradesperson
  • Responsible for work performed by tradespeople
  • Liable for disputes between users
  • An employment agency or employer of tradespeople

All work contracts are directly between homeowner and tradesperson.

5.3 Verification Process

What We Verify:

  • Tradesperson identity and business registration
  • Insurance coverage (at time of listing)
  • Professional qualifications and certifications (where applicable)
  • Business contact information

Important Limitations:

  • Verification is performed at time of listing registration
  • We cannot continuously monitor tradespeople or their credentials
  • Insurance and certifications may expire between checks
  • Verification does not constitute endorsement or guarantee
  • Homeowners should conduct their own due diligence

Homeowner Responsibilities:

  • Always request current insurance certificates before hiring
  • Verify certifications for specialized work (Gas Safe, NICEIC, etc.)
  • Obtain written quotes and contracts
  • Check references independently
  • Ensure appropriate planning permissions are in place

6. User Conduct and Acceptable Use

6.1 General Conduct

All users must:

  • Use the Platform lawfully and respectfully
  • Provide honest and accurate information
  • Communicate professionally and courteously
  • Respect others' intellectual property and privacy rights
  • Comply with all applicable laws and regulations
6.2 Prohibited Activities

You must NOT:

Fraudulent or Deceptive Behavior:

  • Provide false, misleading, or inaccurate information
  • Impersonate another person or business
  • Create fake reviews or testimonials
  • Manipulate ratings or recommendations

Harmful Content:

  • Upload offensive, defamatory, discriminatory, or hateful content
  • Share content that violates others' privacy or rights
  • Post sexually explicit, violent, or inappropriate material
  • Distribute spam, malware, or harmful code

Platform Abuse:

  • Attempt to gain unauthorized access to the Platform
  • Interfere with or disrupt Platform operation
  • Use automated systems (bots, scrapers) without permission
  • Collect or harvest user information without consent
  • Circumvent security measures or verification processes

Misuse:

  • Use the Platform for purposes other than finding or offering trade services
  • Advertise or promote competing directory services
  • Solicit users for unrelated business purposes
6.3 Homeowner-Specific Conduct

As a homeowner, you must:

  • Provide accurate project details in quote requests
  • Respond to tradesperson enquiries reasonably
  • Honor commitments made to tradespeople
  • Leave honest reviews based on actual experiences
  • Pay for services as agreed with tradespeople (directly, not through us)

You must NOT:

  • Submit fake or frivolous quote requests
  • Harass or abuse tradespeople
  • Request quotes with no genuine intent to proceed
  • Discriminate against tradespeople based on protected characteristics
  • Use contact information for unauthorized purposes
6.4 Tradesperson Conduct

Tradespeople are subject to both these Terms and their separate Listing Agreement, which contains detailed conduct requirements including:

  • Professional communication standards
  • Quote and work obligations
  • Review and reputation management rules
  • Prohibited business practices

7. Quote Requests and Communications

7.1 How Quote Requests Work

For Homeowners:

When you submit a quote request:

  • You provide project details and contact information
  • Relevant tradespeople receive your request
  • Tradespeople may respond with quotes
  • You are under no obligation to accept any quote
  • All communication after introduction is directly between you and tradesperson

What We Do:

  • Match your request to relevant tradespeople
  • Facilitate initial communication
  • Display responses you receive

What We Don't Do:

  • Guarantee tradesperson responses
  • Determine pricing or negotiate on your behalf
  • Manage the project or oversee work
  • Process payments between you and tradespeople
7.2 Direct Arrangements

Once introduced through our Platform:

  • All agreements are directly between homeowner and tradesperson
  • Payment arrangements are between the two parties
  • Project scope, timeline, and pricing are negotiated directly
  • Contracts should be agreed in writing
  • We have no involvement in the actual work relationship
7.3 Communication Guidelines

All platform communications must:

  • Be relevant to the quote request or project
  • Remain professional and courteous
  • Respect privacy and personal boundaries
  • Comply with UK communications laws
7.4 Contact Information Use

When users share contact information:

  • It must only be used for the purpose provided
  • It must not be shared with third parties without permission
  • It must not be used for unrelated marketing
  • It must be kept confidential and secure

8. Reviews and Ratings

8.1 Leaving Reviews

Eligibility:

  • Only homeowners who have engaged a tradesperson's services may leave reviews
  • Reviews should be based on genuine, personal experience

Review Requirements:

Reviews must:

  • Be honest and factually accurate
  • Avoid offensive, defamatory, or discriminatory language
  • Focus on work quality and professionalism
  • Comply with UK consumer protection and defamation laws

Reviews must NOT:

  • Be fake or submitted by someone who didn't use the service
  • Include personal attacks or inappropriate content
  • Contain private or confidential information
  • Be submitted in exchange for payment or incentives
8.2 Our Role in Reviews

We May:

  • Remove reviews that violate these Terms
  • Moderate reviews for inappropriate content
  • Investigate suspicious or fraudulent reviews
  • Remove reviews if required by law
  • Edit reviews for formatting (clearly marked as edited)

We Do Not:

  • Verify the accuracy of every review
  • Edit reviews to favor tradespeople or homeowners
  • Remove negative reviews simply because tradespeople disagree
  • Take sides in disputes about review content
8.3 Responding to Reviews

Tradespeople may respond to reviews:

  • Responses must be professional and constructive
  • Personal attacks or aggressive language are prohibited
  • Responses should address issues raised appropriately
8.4 Review Disputes

If you believe a review is false or defamatory:

  • Contact us with evidence supporting your claim
  • We'll investigate and make a determination
  • Our decision on review removal is final
  • You may pursue legal remedies independently if needed
8.5 Review Ownership and License

By posting a review, you:

  • Retain ownership of your content
  • Grant us a perpetual, worldwide, royalty-free license to display, distribute, and use the review on our Platform and marketing materials
  • Confirm you have the right to post the content

9. Intellectual Property Rights

  • "Your Next Builder" name, logo, and branding

  • Text, graphics, and images created by us

You May:

  • View and use the Platform for its intended purpose
  • Share links to our Platform
  • Reference our Platform in appropriate contexts

You May NOT:

  • Copy, reproduce, or republish our content without permission
  • Use our trademarks or branding without written consent
  • Create derivative works based on our Platform
  • Scrape or systematically download Platform content
  • Use our content for commercial purposes without authorization
9.2 User-Generated Content

When You Upload Content (reviews, project details, photos):

You confirm that:

  • You own the content or have permission to use it
  • The content doesn't infringe others' intellectual property rights
  • You have necessary rights to grant us a license

You grant us:

  • A worldwide, non-exclusive, royalty-free license
  • To use, display, reproduce, and distribute your content
  • On the Platform and in marketing materials
  • For as long as necessary for Platform operation

We may:

  • Display your content on the Platform
  • Use it in promotional materials
  • Modify it for formatting or technical reasons
  • Remove content that violates these Terms
9.3 Tradesperson Portfolio Content

Tradespeople who upload project photos must:

  • Have the right to photograph and share the work
  • Obtain homeowner consent for identifiable properties
  • Not include identifiable people without consent
  • Not use others' copyrighted work without permission
9.4 Copyright Infringement

If you believe content on our Platform infringes your copyright:

  • Provide details of the copyrighted work
  • Specify the infringing content location
  • Include your contact information
  • We'll investigate and respond appropriately

10. Privacy and Data Protection

Your use of the Platform is governed by our Privacy Policy, which explains:

Homeowners - What Gets Shared:

When you submit a quote request:

  • Your name and contact details are shared with responding tradespeople
  • Your project information is shared with relevant tradespeople
  • Your location information is shared (as necessary for quotes)

Tradespeople - What Gets Shared:

Business information in listings is publicly visible:

  • Business name and contact details
  • Services offered and location covered
  • Portfolio photos and descriptions
  • Reviews and ratings
  • Professional qualifications
10.3 Your Data Responsibilities

Both Parties Must:

  • Use shared information only for the intended purpose
  • Keep contact information confidential
  • Not share others' personal data without permission
  • Comply with UK data protection laws (GDPR, Data Protection Act 2018)
10.4 Communications

By creating an account, you consent to receive:

Service Communications (cannot opt out):

  • Account notifications and security alerts
  • Quote responses and messages
  • Important legal or policy updates
  • Technical or service announcements

Marketing Communications (can opt out):

  • Tips and advice about home improvement
  • Newsletter with platform updates
  • Information about new features
  • Promotional content

You can unsubscribe from marketing emails at any time using the link in each message.

11. Payment Terms

11.1 No Payment Processing Between Users

Critical Understanding:

We do NOT process, hold, or manage any payments for trade services between homeowners and tradespeople.

All payments for work are made directly:

  • Between homeowner and tradesperson
  • Using their own payment arrangements
  • According to their own terms and agreements

We Are Not Involved In:

  • Setting prices or negotiating costs
  • Processing customer payments
  • Holding funds or escrow
  • Resolving payment disputes
  • Taking commission on work value
11.2 Homeowner Payments

For Trade Services:

  • Negotiate payment terms directly with tradesperson
  • Obtain written quotes before work begins
  • Agree payment schedule in writing
  • Pay tradesperson directly (not through us)
  • Request proper invoices
  • Keep records of all payments

We Cannot Help With:

  • Collecting payment from homeowners
  • Pursuing unpaid invoices
  • Mediating payment disputes
  • Providing payment guarantees
11.3 Tradesperson Listing Fees

Separate from Work Payments:

Tradespeople pay listing fees to Your Next Builder for directory services. These fees are:

  • Governed by the Tradesperson Listing Agreement
  • Completely separate from homeowner payments for work
  • For Platform listing and lead generation only
  • Not commission on work performed

12. Disclaimers and Limitations of Liability

12.1 Service Provided "As Is"

IMPORTANT - PLEASE READ CAREFULLY:

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

We Make No Warranties About:

  • The accuracy, completeness, or reliability of Platform content
  • The quality, safety, or legality of services offered by tradespeople
  • The availability or uninterrupted operation of the Platform
  • The security of the Platform (though we implement reasonable measures)
  • The suitability of any tradesperson for your specific project
  • The outcome of any work performed through our Platform
12.2 No Endorsement or Guarantee

Verification Is Not Endorsement:

Our verification of tradespeople does NOT mean:

  • We endorse or recommend their services
  • We guarantee their work quality
  • We vouch for their reliability or character
  • We ensure their pricing is fair or competitive
  • We monitor their ongoing performance

You Must:

  • Conduct your own due diligence
  • Verify current credentials and insurance
  • Obtain written quotes and contracts
  • Make your own informed decisions
  • Accept responsibility for hiring decisions
12.3 Third-Party Content and Actions

We Are Not Responsible For:

  • Accuracy of information provided by tradespeople in listings
  • Content of user reviews (these are individual opinions)
  • Actions or omissions of tradespeople or homeowners
  • Quality, timeliness, or cost of work performed
  • Disputes between homeowners and tradespeople
  • External websites linked from our Platform
  • Third-party services or payment processors
12.4 Limitation of Liability

To the Maximum Extent Permitted by UK Law:

We shall NOT be liable for any:

Types of Damages:

  • Indirect, incidental, or consequential damages
  • Loss of profits, revenue, data, or business opportunities
  • Personal injury or property damage arising from work performed
  • Losses resulting from payment disputes
  • Damage from unauthorized account access (if due to your negligence)
  • Service interruptions or technical failures

Specific Exclusions:

  • Damage caused by tradespeople's work or conduct
  • Losses from delays or non-completion of projects
  • Costs arising from poor workmanship or defects
  • Legal fees for disputes with tradespeople
  • Damage to property during or after work

Maximum Liability:

Our total liability to any user for all claims shall not exceed:

  • For Homeowners: £100
  • For Tradespeople: Governed by their separate Listing Agreement
12.5 Exceptions to Limitations

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Breach of statutory rights that cannot be excluded
  • Any liability that cannot be limited under UK law
12.6 Your Acknowledgment

By Using This Platform, You Acknowledge:

  • You are solely responsible for hiring decisions
  • You understand we don't employ or control tradespeople
  • You will conduct independent verification before hiring
  • You accept the risks inherent in hiring contractors
  • You use the Platform entirely at your own risk

13. Indemnification

13.1 Your Indemnification Obligations

You agree to indemnify, defend, and hold harmless Your Next Builder, its directors, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

For All Users:

  • Your violation of these Terms
  • Your violation of any law or regulation
  • Content you upload or post
  • Your infringement of others' rights (intellectual property, privacy, etc.)
  • Your use or misuse of the Platform
  • False or misleading information you provide

For Homeowners:

  • Disputes with tradespeople regarding payment or work quality
  • Injury or damage occurring at your property during or after work
  • Claims arising from work you commissioned through the Platform
  • Failure to obtain necessary permits or planning permission

For Tradespeople:

  • Claims arising from work performed (covered in detail in Listing Agreement)
  • Work-related injury, damage, or loss
  • Professional misconduct or negligence
  • Breach of contracts with homeowners
13.2 Defense and Settlement

We reserve the right to:

  • Assume exclusive defense of any claim subject to indemnification
  • Require your cooperation in defense
  • Approve any settlement at your expense

14. Dispute Resolution

14.1 Disputes Between Homeowners and Tradespeople

We Are Not Involved:

For disputes regarding work quality, payment, completion, or any aspect of the project:

You Must:

  • Resolve issues directly with the other party
  • Maintain written records of all agreements and communications
  • Refer to your written contract or quote
  • Consider mediation or alternative dispute resolution
  • Seek independent legal advice if necessary

We May:

  • Provide contact information to facilitate communication
  • Remove listings if serious misconduct is evidenced
  • Cooperate with legal proceedings if required by law

We Will NOT:

  • Act as mediator or arbitrator
  • Make judgments about who is at fault
  • Provide legal advice
  • Enforce contracts or payment
  • Investigate work quality issues
  • Award damages or compensation
14.2 Recommended Resolution Steps

For work disputes:

  1. Document the issue with photos and written descriptions
  2. Communicate your concerns directly to the other party in writing
  3. Reference your written contract or quote
  4. Allow reasonable time for resolution
  5. Consider requesting an independent assessment
  6. Explore mediation before legal action
  7. Seek legal advice if resolution fails
14.3 Disputes With the Platform

If You Have a Complaint About Our Service:

If You Are a Consumer:

Continued use after the effective date constitutes acceptance of modified Terms.

17. Account Termination

17.1 Termination by You

Homeowners:

  • May stop using the Platform at any time
  • May request account deletion
  • Have no ongoing obligations after stopping use

Tradespeople:

  • Follow termination process in Tradesperson Listing Agreement
  • May have notice period and outstanding obligations
  • Subject to separate contractual terms
17.2 Termination or Suspension by Us

We May Suspend or Terminate Your Account If:

  • You materially breach these Terms
  • You engage in fraudulent or illegal activity
  • Your conduct harms or threatens other users
  • You provide false or misleading information
  • Required by law or regulatory authority

Notice:

  • We'll provide notice except where immediate action is necessary
  • You may appeal termination within 14 days
  • Our decision is at our sole discretion
17.3 Effect of Termination

Upon termination:

  • Your access to the Platform ceases immediately
  • Your account and data may be deleted (subject to legal retention requirements)
  • Outstanding obligations remain in effect
  • Certain provisions survive termination (see below)
17.4 Surviving Provisions

The following survive termination:

  • Intellectual Property Rights
  • Indemnification obligations
  • Disclaimers and Limitations of Liability

18. General Provisions

These Terms, together with:

  • Our Cookie Policy
  • Tradesperson Listing Agreement (for tradespeople)

...constitute the entire agreement between you and Your Next Builder.

18.2 Severability

If any provision is found unenforceable or invalid:

  • It will be modified to the minimum extent necessary
  • If modification isn't possible, it will be severed
  • Remaining provisions remain in full effect
18.3 Waiver

Our failure to enforce any provision doesn't constitute a waiver of:

  • That provision
  • Our right to enforce it in the future
18.4 Assignment

You May Not:

  • Transfer or assign your rights under these Terms without our consent

We May:

  • Assign or transfer our rights to another company
  • In the event of merger, acquisition, or sale
  • You'll be notified of any such transfer
18.5 No Third-Party Rights

These Terms are between you and Your Next Builder only. No third party has rights under the Contracts (Rights of Third Parties) Act 1999.

18.6 Force Majeure

Neither party is liable for failure to perform due to circumstances beyond reasonable control:

  • Natural disasters
  • War, terrorism, or civil unrest
  • Government restrictions
  • Pandemic or public health emergency
  • Internet or telecommunications failures
  • Power outages or technical infrastructure failures
18.7 Relationship of Parties

Important Clarification:

  • Your Next Builder is a directory platform only
  • We don't employ tradespeople
  • Tradespeople are independent contractors
  • No employment, partnership, or agency relationship exists
  • Contracts for work are solely between homeowner and tradesperson
18.8 Notices

Notice Delivery:

  • Email: 24 hours after sending (if not bounced)
